Terms of reference
The restitution files (abbreviated: RK-Akten) were opened during proceedings conducted before Klagenfurt Provincial Court pursuant to the Third Restitution Act. On the whole, the restitution proceedings involved assets (here, in particular, real estate), that had been seized from members of the Slovene minority in Carinthia. The remainder dealt with assets that had been seized from the Jewish population, as well as from Slovene associations and societies, cooperatives and ecclesiastical institutions, for example. Several sets of proceedings were merged for practical reasons and ultimately conducted as a single proceeding; others were transferred to the Financial Directorate Carinthia because they met the requirements of the First Restitution Act or the Second Restitution Act, or were transferred to the Restitution Commissions of other provinces.
The restitution files are an important source of information for the General Settlement Fund when investigating facts relevant to restitution cases in the Province of Carinthia.
Digitization
The finding aid for the files of the Restitution Commission at the Provincial Court Klagenfurt at the Carinthian Provincial Archives was recorded electronically by a staff member of the General Settlement Fund between 2011 and 2014. The name of the complainant and the file number of the restitution proceedings were taken from the alphabetical list of names drawn up for the Restitution Commission at Klagenfurt Provincial Court between 1947 and 1957/58. A further, this time numerical, register volume (Restitution and Restoration Commission at Klagenfurt Provincial Court), provided information on the outcome (ruling), subject of proceedings (noted until at least 1948) and the annotations. The latter was generally included if the file was later transferred to the Financial Directorate or Restitution Commissions in other provinces, or was bundled or merged with another Restitution Commission file number.
In addition, box numbers (taken from an internal finding aid produced by the archive), which are required to locate and take out a file, were also included.
The entries copied into in the register volumes, which, to some extent, are barely legible, needed to be checked against the original files; this took place in spring 2014, enabling a list to be created of the files actually available in the archive at this point in time. This information can be found in the remarks.
Processing the digitized data
The digital finding aid for the Restitution Commission files at the Carinthian Provincial Archives is the most accurate portrayal possible of the two register volumes contained in the archive. The only adaptation made at this early stage of processing is that, for the Findbuch, one record was created for each aggrieved person. As a result, the finding aid for this series of files now comprises 2020 records.
Additional adaptations had to be made for the Findbuch database. Separate columns were created for natural persons and legal persons. The information from the columns “ruling”, “subject of proceedings”, “remarks” and “information on file holdings” were summarized in the field “remarks”.
Obvious orthographical errors and incorrect spellings were amended without comment. As far as one could be clearly established, a place was attributed to legal persons.
